    I posted my original story and my follow up in the turbo failure thread. It’s on the last page, but I did just complete a replacement of my 22 tundra through PA lemon law and the Toyota replacement program. They built my same exact truck in a 25 and we exchange keys and I went on my way

    NICE. I had a similar experience with a Volvo C70 for my wife many years back. I swapped 28K miles for a brand new car and the experience was very easy and transparent. The car was truly a lemon. Toyota 3rd gen is clearly a fuck up if you ask me :)

    Guy at work is in the process of a buyback on his 24 Pro. Hybrid unit noise, nor dealer or engineers dont know how to fix it apparently. Do they make you whole again? Like did you loose any money with the buyback? He lawyered up because, the dealer, which is garbage like I told him from the start and not to shop there, is not being helpful. I believe he wants to not loose any money at the end, but I told him I dont know about that since the truck already has miles on it and he's owned it for some time.

    So I bought my truck January of 22 I just received the new 25 December 10 of this year. I started the claim when the truck had 33,000 miles when this swap happened the 22 had 40,000 miles no money exchanged hands.

    Dealer have nothing to do with the buyback. Is the Toyota HQ. Dealer is just the middle man.

    I received sticker plus ,sales tax , and tags, minus .67 cents per miles.

    They will also deduct if you have damages, don't have both keys and the owners manual.

    I do know lemon laws very by State. I have a friend who owns a local Volkswagen dealership and I reached out to him and he said before you hire a lawyer because it’s probably not gonna work out in your favor see what Toyota corporate offers first and then go from there and that’s what I did.

    So I negotiated the mileage part down to nothing. That also varies by state and your lemon lawS

    I will say I started the claim when the turbo debacle happened. I refer back to my original post in the turbo failure thread. They kept pushing me to accept my truck and I finally flat out Said I would like to open a lemon law claim and that’s how the whole process started. I will say the lady I dealt with from Toyota corporate was spectacular through the whole process.

    It was a long process as I had to wait for the plant in Texas to start building the same truck I had previously ordered with the same options. all in all from start to finish June 2024 to receiving my new truck, December 2024

    They asked me at the beginning of the process if I wanted a replacement or a refund when I contacted the customer experience center.I went refund.

    I started the process and then someone contacted me and gave me both options a buyout or replacement and laid out what each one would entail and what I would get in return and then I chose the replacement. I did have a mileage clause that I was responsible for per state law From the date that the original problem I opened the claim for started, but I was able to negotiate that down to nothing through multiple emails and phone calls. I will also say the lady from Toyota corporate was available per phone call directly every time I called.

    Probably at straight proration against what was paid and amount of 120,000 miles used? The higher the value the higher the cost per mile settlement.

    67 cents is the current amount the IRS allows you to deduct for business expenses etc. It's going up to 70 cents next year.

    67 cents a mile is a reimbursement calculation that covers depreciation and maintenance performed. It should not be used for a mileage deduction when bartering the cars value. That would mean a vehicle is worth $67k less at 100k miles. However a $67k Tundra when new will not be worth -$33k at 100k miles, it will probably be worth about $40k or so.

    Correct i was not even told they were going to deduct any ammount threw the process.I was told to keep on driving.I did not, i parked the tundra.I assumed their would be some sort of use /mileage deduction.I looked online and came up with .67 cents and that's exactly what the agent deductd and wanted to deduct any and everything they could down to you better have the owners manual.

    In my state the .67 rate applies for 24 month's or 24k miles.

    I can also tell you for purposes of the mileage deduction the mileage stopped accumulating the day I first brought the truck in for the problem that I was filing the lemon law claim with. In my case somewhere around 33,000 miles when the exchange happened the truck had just over 40,000 miles

    Kind of a long story, but I thought it was worth sharing and hopefully could help some other tundra owners out in the future. I have a 22 SR5 OR with a 12/21 build date. I purchased the truck January 13 of 22. At 28,000 miles the truck went to the dealer with a check engine light turbo B wastegate stuck closed. The technician said they had a permanent sometimes temporary fix. I opted that route. They advised me that if the check engine light came in again they would need to replace the turbo. Six months later the check engine light came on with 35,000 miles. I took it back to the dealer. They said a turbo needed replaced so I dropped the truck off June 15. Went back July 10 to pick up the truck and low and behold they replaced the wrong turbo. So they said they needed to take the cab off and replace the other turbo. While this was happening I opened up a case with Toyota and I also filed a lemon law claim through Toyota. As of today both turbos were replaced. The truck is in my possession. Toyota offered me two options as far as Pennsylvania lemon law goes. They would purchase my truck for what I paid for it plus total interest of my entire loan or they would replace the truck. I opted for the replacement. They are replacing it with a not yet built 25. I just received an email today of a 10/7 estimated build date and possibly in the new truck by Christmas. Same exact truck and it will essentially be a key swap. I take my truck and hand them two sets of keys. They give me a brand new 25 exact same truck. Everything else stays the same as far as terms and conditions . Hopefully this helps everyone. As of right now my truck to date has spent more than three months at the dealership.

    I can’t tell you the number they initially hit me with for the mileage equated to roughly $.10 cents a mile

    So, just to be clear, the lemon law claim was based on length of time in the service shop trying to address one problem? Did you lawyer up to file the claim, or do it yourself? Did the dealership give you a loaner, and was it another Tundra?

    Overall, it sounds like Toyota treated you very well. You showed a lot of loyalty by accepting a replacement Tundra instead of a check. I'm not sure I could have done that in your shoes.
