Does anyone know if a class action lawsuit has been filed over the engine failures? From what I have read Toyota has known about this issue for a while but only issued a recall on 5/30/24. I bought the truck to tow my camper. My grandsons like camping with the wife and I but I cannot take a chance on the engine failing with them with me and having a camper I would have to tow. Considering the uncertainty of this truck I have to stay close to home. This really makes this truck useless. I have also had a lot of other problems that qualified me for a lemon law buy back but Toyota decided not to follow Ohio law along with the mediation company they use. I am going to wait and see what they do for the fix but it looks like legal action is down the road for me.

Well there is a class action lawsuit for the fuel lines even though Toyota the recall and fix. I'm not sure why this would be any different.

Toyota will probably need to expand to 24s pretty soon and hybrids for this very reason. This is not legal advice*

The Kia/Hyundai engine suit just got a final settlement recently. Some of those vehicles are 9-12 years old and owners paid out of pocket for repairs many years ago are just now getting compensation. Class action is the best way to make sure you get to pay out of pocket for out of warranty failures and wait a decade to get part of it back.

I agree, 2024's are failing also. I wonder if it is a design problem?

None of the Automakers will follow the lemon law. I had to get a lemon law lawyer. This does not cost you a thing as the Auto company has to pay them. I suggest you find a lawyer in your State and not in a different State to handle this for you. It took me 2 1/2 years to get all money back from GM for Chevy Silverado that qualified under the lemon law within 3 months of buying it. The truck was a total lemon with the engine blowing out at 308 miles and other issues with a total of 39 days in the shop in the first year. Do not try to deal with Toyota or any other automaker your self they will stone wall you as they did with me until I got a lawyer that cost me nothing and they had to pay for. PS they did not want to settle until we were ready for our case to move forward in the court.

I'll just leave this here -

Class action can be lower payout -

    https://www.freep.com/story/money/c...-l-diesel-engine-costs-ford-again/3626782001/

"A top legal expert in the U.S. told the Free Press that Margeson's victory is a powerful example of how a class action case can be used to prevent potentially billions in costs when things go wrong with consumers, in this case for Ford.

"The company dodged a bullet," said Brian Fitzpatrick, a law professor at Vanderbilt University who clerked for the late U.S. Supreme Court Justice Antonin Scalia.

Just dumb to think about this now before you even know what the remedy is going to be.

What exactly happened with your truck? Is there something specific the dealer couldn't fix after several attempts or was it in the shop for more than 30 days? Having to take the truck to the dealer or a handful of small (Even though probably annoying) issues generally wouldn't put you in the lemon law category. It doesn't sound like your engine has actually failed either. Just curious.

I met three of the Ohio lemon law criteria before this latest issue but did not get a lawyer at that time. I also would not file a lemon law case on what has not happened only what has happened before. It would be foolish to do anything else. I met 2 or 3 of the Ohio lemon law requirements and you only need 1. I won't get into all the problems on a forum but they have been extensive. I just never expected this poor of quality from Toyota. My last Toyota was absolutely perfect and I don't believe it had any recalls. I wanted something bigger for towing. I waited a year after the release of the gen 3 before I bought the Tundra. I was really relying on Toyota's past quality record but that this truck has been very disappointing. It is really a ticking bomb that could go out at any time.

If a manufacturer ignores a problem with a vehicle I might consider your point of view. But we live in a litigation happy country and I believe it has hurt our country more than it has helped. Toyota has owned the problem and will advise their remedy. This is already more than what most manufacturers do. Maybe we will get a new motor. My build date is 2/22 so I too am at risk.

Everyone is a victim in this country and that mindset is destroying our country. It makes us more self centered. Go sell your truck and buy something else so you can go camping without worrying. I promise you that will be much happier selling it than you will if you get involved in a legal battle. Unless you like being a victim.

I'm a little confused about some of these comments. I already went to Toyota and their arbitration company and they refused my buyback request even though I met the requirements of my state's law on at least 2 or 3 of their criteria and you only need to meet 1 of the items. If Toyota does not follow my state's law then the only avenue left for a buyback is getting lawyers involved. I don't like going that route but I have to have something that I can depend on. Some car dealers are not even taking these back in on trade in. If they do take a trade in then it would be at dealer wholesale which is way below the blue book. Why should I take a big loss by trading it in? I am sure most people do not want to throw their hard earned money away. Some people have not had problems but mine has been riddled with one issue after another. Personally I believe there is more to the story than engine debris causing the problem and I am not the only one who thinks that is the case.

Sadly the systems are made to feast on those who will not get professional representation...Dealeships and repair shops care nothing about you or your losses/damages.

I really wish that wasn't the case.

I know nothing of lemon laws tho so that may be a different ball of yarn.

More a product of “can’t afford” professional representation, I think. They bank on making more on margins than they payout in damages. Or so various courts have found through the discovery process

If you fit within your state's lemon law, you generally need to file a claim with your state's lemon law arbitration service, which is usually part of the attoeney general's office. Nothing wrong with approaching Toyota directly, but it is not the proper way to make a lemon law claim.
