    My son has 2022 Tundra. Just told engine needs to be replaced again, this is second engine replaced. Is this a lemon ??? Less than 35,000 miles.

    Lemon Laws vary from state to state, but usually they only apply to cars that are less than 1 year old. However, I think you have a strong case to get a refund / settlement from Toyota. Google for local lemon law lawyers in your state and contact a few. I'm pretty sure one or two will take your case. Two engine replacement on such a new vehicle is clearly something unacceptable. Also, contacting your local news TV station maybe worth doing. Toyota is extremely worried about their reputation, so they don't want bad publicity. Actually, this is the main reason why Toyota usually settles lemon cases directly with owners, before they are decided by the District Attorney office. This way they keep their lemon statistics artificially low, giving the impression that they build reliable cars (they don't).

    Toyota had OCI (Oil Change Interval) superseded with ECI (Engine Change Interval), starting with Gen3 Tundra. 35k for the second engine seems a bit overdue, but nothing concerning yet. Much better than those V8 acolytes may ever hope to get to.

    Where did you come up with this? The greater of manufacturer warranty or 1 year after discovery of defect.

    Have you been successful with a Lemon Law buyback?

    First time they replaced a defective short block with another defective short block. It looks like Toyota finally figured out what they did wrong with the block, so this time you may actually get a good one. If the dealer won't screw it up, which is always a possibility...

    Kentucky: According to Kentucky state laws, the vehicle is considered a lemon when: It has a fault within the first 12,000 miles on the odometer or 12 months of purchase (whichever comes first).
    Ohio: You are covered by the state's Lemon Law if the problems with your new motor vehicle occur during the first 12 months or first 18,000 miles of ownership, whichever comes first.
    New York: The New Car Lemon Law provides a legal remedy for buyers or lessees of new cars that tum out to be lemons. If your car does not conform to the terms of the written warranty and the manufacturer or its authorized dealer is unable to rep air the car after a reasonable number of attempts during the first 18,000 miles or two years, whichever comes first
    Colorado
    : Under the law, a “reasonable number of attempts” to repair a defect applies when the same defect remains after it has been subject to repair four (4) or more times within the first year after the date of original delivery. It also applies when the vehicle is out of service for repairs for a cumulative total of thirty (30) or more business days during the warranty term or one year after original delivery, whichever comes first.

    Every state has different rules, some are more generous, other are quite restrictive. Most of them limit the term to one or two years, and a fairly limited mileage. Only a handful of states extend the lemon law to the entire manufacturer's warranty period.

    That stinks but I am glad he is at least getting cooperation for another replacement. In general it sounds like a lemon but the laws vary so much that it may cost more for an attorney than most can afford. I just wish him the best of luck with the new engine!
